There were those who said spam was no big deal — you get junk mail don’t you? But the reality was it was different. Like fake news, spam costs nothing to produce and spread to millions of people while controlling it and shutting it down costs a lot.
Governments already have a lot of involvement in regulating the internet and other communications media. Its all within the constitution unless you want to cite something specific.
Thankfully regulation been a light touch on the internet so far in the US, but it hasn’t been without battles like net neutrality, encryption, etc. US laws have been instrumental in controlling spam. So, yes, there is a role and they have the authority.
